Weeds

Local Councils are responsible for enforcing weed legislation.  This includes activities such as:

  • Conducting weed inspections on public and private property;
  • Inspecting and controlling weeds in high risk pathways and sites;
  • Providing education, training and resources for both the public and staff in relation to weed management;
  • Administering and ensuring compliance with any of the above regulatory tools;
  • Responding to breaches of the Act;
  • Notifying and reporting on weed activities to the Biosecurity Information System (BIS).

This activity happens under the umbrella of the Biosecurity Act 2015 (Act). This legislation act replaced the earlier Noxious Weed Act 1993 in July 2017.

Biosecurity

A commitment to biosecurity will protect the economy, environment and community from the negative impacts of pests, diseases and weeds.

It is vital for the health, wellbeing and prosperity of the region.

The Central Tablelands Regional Strategic Weed Management Plan focuses on managing weeds to improve the region’s biosecurity.

Our vision is to protect the Central Tablelands region’s environment, landscape, livelihood, cultural and lifestyle values from weeds by strengthening the sustainability of the natural environment, primary industries, and local communities in the region.

Pesticide Use Notification Plan

The Pesticide Use Notification Plan has been prepared according to the requirements of the Pesticides Regulation 1995 (the Regulation).

The intention of the plan is to ensure the community is notified when pesticides are used within the Orange City Council area, so residents are able to avoid contact with these pesticides if they wish.

The aim of the plan is to meet the community’s general right to know about pesticide applications made in public places that are owned or controlled by Orange City Council. The plan states that Council routinely directs and allows the use of herbicides in public places as part of its functions.

The use is designed to destroy, suppress or prevent the spread of weeds or unwanted pest species and to protect the users of public places from nuisance or danger or for the beautification, management and maintenance of parks and reserves.

Categories of weed

Under weeds management legislation, weeds are classified under a one of a number of headings which describe how they are managed and controlled.

These include : 

Prohibited Matter

This category describes biosecurity matter (weeds), (that are listed in Schedule 2, Part 1 of the NSW Biosecurity Act 2015) to prevent entry of that material into NSW.

The prohibited matter relevant to the region is listed in Appendix A1.1 of this plan. Prohibited matter also includes weeds nationally targeted for eradication and presently not in NSW.

Control Order

This category establishes one or more control zones and related measures to prevent, eliminate, minimise or manage a biosecurity risk or impact.

Control orders are for managing weeds under approved eradication programs and last for five years (or can be renewed for longer-term eradication programs).

A Weed Control Order 2017 (Part 6 Division 1) under the NSW Biosecurity Act 2015 includes weeds that are subject to a Control Order for the purpose of eradication. Further Control Orders will be proposed as needed to address subsequent eradication campaigns.

Biosecurity Zone

This category aims to contain a weed species and provides for ongoing strategic management in a defined area of the state.

A Biosecurity Zone specifies the measures that must be taken in the defined area to manage the weed. Outcomes to demonstrate compliance with the GBD may also apply to the species either within the zone or outside it.

Mandatory Measures regulation

This category requires parties to take specific actions with respect to weeds or carriers of weeds. Mandatory Measures are defined in the regulations and include :

the prohibition on certain dealings ( including Weeds of National Significance (WoNS) (Division 8 Clause 33), Parthenium weed carriers – machinery and equipment (Division 8 Clause 35)), and

the duty to notify about the importation of plants into the state (Division 8 Clause 34). Mandatory measures relevant to the region are listed in Appendix 1.

General Biosecurity Duty (GBD)

The purpose of the GBD is to manage the spread and/or impact of all weeds that pose a biosecurity risk. The GBD is in addition to any requirements included in a Control Order, Biosecurity Zone or other instrument made under the NSW Biosecurity Act 2015.

For priority weeds, outcomes to demonstrate compliance with the GBD are detailed in Appendix 1 of this plan.

Key Terms of the NSW Biosecurity Act 2015

Authorised Officer

A person who is appointed as an authorized officer under the Biosecurity Act and is authorised by that appointment to exercise the function in relation to which the expression is used.

General Biosecurity Duty

Any person who deals with biosecurity matter or a carrier and who knows, or ought reasonably to know, the biosecurity risk posed or likely to be posed by the biosecurity matter, carrier or dealing has a biosecurity duty to ensure that, so far as is reasonably practicable, the biosecurity risk is prevented, eliminated or minimised.

Undertakings

(1)  An authorised officer may accept a written undertaking (a biosecurity undertaking) given by a person if the person has contravened. or the authorised officer suspects that the person has contravened. or is likely to contravene. a requirement imposed by or under this Act.

(2)  An authorised officer may accept a biosecurity undertaking from a person instead of giving the person a biosecurity direction.

(3)  The giving of an undertaking does not constitute an admission of guilt by the person giving it in relation to the contravention, suspected contravention or likely contravention to which the undertaking relates.

Individual Biosecurity Direction

(1)  An authorised officer may give an individual biosecurity direction that prohibits, regulates or controls (absolutely or conditionally) the doing of anything by the person to whom the biosecurity direction is given if the authorised officer reasonably believes the direction is necessary for any of the following purposes:

(a)  to prevent the person from contravening or continuing to contravene a requirement imposed by or under this Act,

(b)  to prevent, eliminate or minimise a biosecurity risk,

(c)  to prevent, manage or control a biosecurity impact that has occurred, is occurring or is likely to occur,

(d)  to enforce, administer or execute this Act (including an instrument made under this Act).

(2)  An authorised officer may also give an individual biosecurity direction that requires a person to do anything if the authorised officer reasonably believes the direction is necessary for any of the following purposes:

(a)  to ensure the person discharges a biosecurity duty of the person under this Act,

(b)  to ensure that the person remedies a contravention, suspected contravention or likely contravention by the person of a requirement imposed by or under this Act,

(c)  to prevent, eliminate, minimise or manage a biosecurity risk posed by a dealing of the person, or suspected dealing of the person, with biosecurity matter, a carrier or a potential carrier,

(d)  to enforce, administer or execute this Act (including an instrument made under this Act).

This table is a list of weeds that may be found across NSW.

The tables includes the common name of the weed, and its botanical name.

Each weed has also been assigned a ‘duty’ which outlines the required response by the landholder if the weed is found.

The range of duties includes :

Prohibition on Dealings : These are specified weeds which can’t be imported into NSW or sold within NSW.

Prohibited Matter : This term applies to any terrestrial of freshwater weed which is banned (as listed in Schedule 2 of the Biosecurity Act of 2015).

Biosecurity Zone : This is a specified area of land where specific plant or plant matter may require control.

Regional Recommended Measure : This duty outlines a recommended method of controlling specific weeds within a region.

Within the Biosecurity Zone this weed must be eradicated where practicable, or as much of the weed destroyed as practicable, and any remaining weed suppressed. The local control authority must be notified of any new infestations of this weed within the Biosecurity Zone.

The Bitou Bush Biosecurity Zone is established for all land within the State except land within 10 kilometres of the mean high water mark of the Pacific Ocean between Cape Byron in the north and Point Perpendicular in the south.
Within the Biosecurity Zone this weed must be eradicated where practicable, or as much of the weed destroyed as practicable, and any remaining weed suppressed. The local control authority must be notified of any new infestations of this weed within the Biosecurity Zone.
Black knapweed Centaurea X moncktonii Prohibited Matter :

All species in the Rubus fruiticosus species aggregate have this requirement, except for the varietals Black Satin, Chehalem, Chester Thornless, Dirksen Thornless, Loch Ness, Murrindindi, Silvan, Smooth Stem, and Thornfree.
